1. Overview
This Acceptable Use Policy ("AUP") sets forth the rules and guidelines that govern the use of the Sellvy platform located at sellvy.io (the "Platform"), operated by Sellvy, Inc., a Delaware corporation with its principal office at 131 Continental Dr, Suite 305, Newark, DE 19713, United States ("Sellvy," "we," "us," or "our").
This AUP applies to all users of the Platform, including Sellers, Buyers, and visitors. By accessing or using the Platform, you agree to comply with this AUP. Violation of this AUP may result in account suspension, termination, forfeiture of funds, and/or legal action.
This AUP supplements and is incorporated into our Terms of Service. In the event of a conflict between this AUP and the Terms of Service, this AUP shall take precedence with respect to acceptable use matters.
2. Prohibited Products
The following categories of products and services are strictly prohibited from being sold, distributed, or promoted through the Platform:
2.1 Illegal Goods and Services
- Controlled substances, narcotics, or drug paraphernalia
- Weapons, ammunition, explosives, or weapon-making instructions
- Stolen goods, counterfeit products, or items obtained through fraud
- Products that violate export control laws or trade sanctions
- Human trafficking or exploitation-related content
2.2 Harmful or Abusive Content
- Malware, viruses, spyware, ransomware, or other malicious software
- Exploits, vulnerability kits, or hacking tools intended for unauthorized access
- Stolen credentials, personal data, or compromised accounts
- Child sexual abuse material (CSAM) or content sexualizing minors
- Non-consensual intimate imagery or deepfakes
- Content promoting self-harm, suicide, or eating disorders
2.3 Fraud-Related Products
- Fake documents, forged identification, or counterfeit currency
- Financial fraud tools (carding guides, cashout methods, bank drops)
- Social engineering kits or phishing templates
- Fake reviews, followers, likes, or engagement services
- Pyramid schemes, Ponzi schemes, or multi-level marketing scams
2.4 Infringing Content
- Pirated software, games, movies, music, or books
- Nulled scripts, cracked plugins, or bypassed license keys
- Products that infringe on copyrights, trademarks, or patents of third parties
- Unauthorized reproductions or derivatives of copyrighted material
2.5 Regulated Products Without Compliance
- Gambling or lottery services without proper licensing
- Unregistered securities, investment contracts, or financial instruments
- Tobacco, alcohol, or cannabis products where prohibited by law
- Adult content without proper age verification mechanisms
3. Prohibited Conduct
Users of the Platform shall not engage in the following conduct:
- Misrepresenting your identity, affiliation, or the nature of your products
- Creating multiple accounts to evade suspensions, bans, or restrictions
- Manipulating search rankings, reviews, ratings, or other Platform metrics
- Harassing, threatening, intimidating, or abusing other users
- Posting hate speech, discriminatory content, or content that incites violence
- Using the Platform to facilitate money laundering, terrorist financing, or sanctions evasion
- Interfering with other users' ability to use the Platform
- Providing false information during account registration, verification, or disputes
- Circumventing Platform fees, payment processing, or delivery mechanisms
4. Fraud and Abuse Prevention
Sellvy maintains zero tolerance for fraudulent activity. The following are specifically prohibited:
4.1 Payment Fraud
- Using stolen credit cards, bank accounts, or payment methods
- Initiating chargebacks or disputes in bad faith
- Creating transactions with yourself to inflate revenue or generate fraudulent payouts
- Exploiting payment processing vulnerabilities or race conditions
4.2 Platform Abuse
- Automated scraping, crawling, or data harvesting without authorization
- Reverse engineering, decompiling, or attempting to extract source code
- Using bots, scripts, or automated tools to interact with the Platform without permission
- Attempting to access other users' accounts, data, or private information
4.3 Affiliate Fraud
- Self-referrals or using fake accounts to generate affiliate commissions
- Cookie stuffing, click fraud, or other deceptive referral practices
- Misrepresenting affiliate relationships or earnings potential
5. Content Standards
All content uploaded to the Platform, including product listings, descriptions, images, and storefront customizations, must adhere to the following standards:
- Content must be accurate, truthful, and not misleading
- Product descriptions must accurately reflect the product being sold
- Images must be relevant to the product and not violate third-party rights
- Content must not contain malicious code, hidden links, or tracking pixels without disclosure
- Pricing must be transparent with no hidden fees or deceptive pricing practices
- Content must comply with applicable advertising and consumer protection laws
6. Security Requirements
All users are expected to maintain the security of their accounts:
- Use a strong, unique password for your Sellvy account
- Enable two-factor authentication (2FA) when available
- Do not share your login credentials with unauthorized individuals
- Report any suspected unauthorized access to your account immediately at security@sellvy.io
- Keep your payment and payout information up to date and secure
- Do not store sensitive buyer data outside the Platform
7. Network and Infrastructure Abuse
Users must not engage in activities that harm or degrade the Platform's infrastructure:
- Denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks
- Excessive API calls or request rates that degrade service for other users
- Exploiting vulnerabilities in the Platform without responsible disclosure
- Injecting malicious content, scripts, or payloads into the Platform
- Intercepting, monitoring, or modifying communications between other users and the Platform
If you discover a security vulnerability, we encourage responsible disclosure through our security contact at security@sellvy.io. We do not pursue legal action against good-faith security researchers who follow responsible disclosure practices.
8. Reporting Violations
If you become aware of any violation of this AUP, we encourage you to report it. You can report violations through the following channels:
- Email: abuse@sellvy.io
- In-Platform:Use the "Report" button on any product listing or storefront
- DMCA Takedown: dmca@sellvy.io for copyright infringement reports
All reports are reviewed by our Trust & Safety team. We may request additional information from the reporting party. Reports are treated confidentially to the extent permitted by law.
9. Enforcement
Sellvy reserves the right to take any of the following actions in response to violations of this AUP, at our sole discretion:
- Warning: Written notice of the violation with a request for corrective action
- Content Removal: Removal of offending product listings, storefront content, or other materials
- Account Suspension: Temporary restriction of access to some or all Platform features
- Account Termination:Permanent removal of the user's account and all associated data
- Fund Withholding: Temporary or permanent withholding of payouts pending investigation
- Legal Action: Referral to law enforcement or initiation of civil legal proceedings
The severity of enforcement action will depend on the nature and severity of the violation, whether it is a repeat offense, the impact on other users and the Platform, and the user's cooperation with Sellvy during any investigation. We strive to act proportionally but reserve the right to take immediate action without prior notice for severe violations.
10. Changes to This Policy
We may update this Acceptable Use Policy from time to time. When we make material changes, we will notify users through the Platform, by email, or by posting a prominent notice on our website. Your continued use of the Platform after such changes constitutes your acceptance of the revised AUP.
We encourage you to review this AUP periodically to stay informed about what conduct and content is acceptable on the Platform.
